What Is the Difference Between Child Custody and Visitation?

Child custody refers to legal custody, which is the right to make decisions for the child, as well as physical custody, which addresses who the child lives with. Physical custody can come in the form of joint custody, in which it is split between the two parents, or sole custody, in which one parent spends all or most of the time with the child.

Child visitation addresses the right of the non-custodial parent to be a part of the child's life. Visitation arrangements are often very specific, involving a schedule that allows a parent to see the child every other weekend, one weekend a month, one week a month or something similar.

What Is a Parenting Plan?

In Massachusetts, parenting plans are becoming the most common way to maintain relationships between parents and children. These plans can be extremely flexible. They can work in conjunction with custody arrangements, or they can be used in place of custody arrangements.
